LF “Jurline” has successfully defended the interests of big grain trader

The team dispute resolution practice of the law firm «Jurline» has successfully defended the interests of big grain trader (Kyiv) in litigation with the State Tax Inspection (STI) in Shevchenkivsky district of Kyiv. The subject of the proceedings was recognition as unlawful and cancellation of tax assessment notice on additional charge to firm’s client’s tax liabilities for income tax in the amount of more than 2.8 million UAH. The basis for the additional charge of tax liabilities was the conclusion of the inspection about allegedly understated nature of operations under the agreement for the supply of grain crops as well as the fact of initiation of a criminal case against officials of the counterparty provider. This dispute was accompanied by lawyers of the LF “Jurline” in the courts of appeal and cassation. In proceedings before the Administrative Court of Appeal of Kyiv the fallacy of the position of fiscal authority was proved, unjustified judgement of the court of first instance was cancelled, and the company’s claim was satisfied. As a result of the review of the decision of appeal court the High Administrative Court of Ukraine on 06.11.2014 issued a ruling which dismissed the cassation claim of the STI in the Shevchenkovskiy district of Kyiv and upheld the ruling of appeal court issued in favour of the taxpayer. Thus, the lawsuit was settled in favour of the firm’s client.
