The lawyers of the Law Firm “Jurline” have defended the interests of the client in the case of contesting of contractor agreement valued at more than 1 million USD

The team of the Dispute Resolution practice of the Law Firm “Jurline” has successfully defended the interests of the construction company in the proceedings which were initiated by the prosecution authorities and the State financial inspection in Odesa region. The regulatory authorities filed the lawsuit to invalidate the decision of the Committee of competitive bidding on acceptance of the bid of the participant, and also on invalidation of the agreement of purchase of contractor work at the expense of public funds in the amount exceeding the equivalent of 1 million USD.

The litigation was initiated by the Prosecutor’s Office basing on the results of the inspection of the client’s compliance with public procurement law. The inspection was held in conjunction with the State financial inspection in Odesa region.

The ground for filing the lawsuit by the prosecutor was the conclusion of inspectors that the client allegedly violated the rules of the bidding: breach of the procedure of publication of information about bidding and violations in determination of the bid evaluation criteria, whereby the bid of participant with the highest price had been accepted.

During the course of the court proceedings our lawyers have proven the compliance of bidding customer’s actions with all legal requirements and absence of grounds for invalidation of the agreement of purchase of contractor work at the expense of public funds. The dispute was resolved in favour of the client in all instances.
