The lawyers of the Law firm “Jurline” successfully defended the interests of big agricultural trader in a tax dispute worth more than 6 million UAH
The dispute resolution team of the Law firm “Jurline” successfully defended the interests of a group of agro-companies (import and distribution of plant protection products, seed, and fertilizers) in litigation dispute with the State Tax Inspection in Kyivskyi district of Odesa.
The subject of legal proceedings was recognition as illegal and cancellation of three tax notices-decisions on additional tax liabilities for income tax and VAT totalling more than 6 million UAH.
The basis for accrual of tax liabilities was a conclusion of the inspectors about the alleged paper-only character and the invalidity of certain contracts of supply executed by the client. At the same time, during the procedure of the client’s administrative appeal of actions of the State Tax Inspection, a repeat audit was conducted, and tax inspection made a new act of tax audit, which conclusions contradicted with the previous act of tax audit of the State Tax Inspection. However, new tax notices-decisions were not adopted, and the administrative appeal process was not successful.
The lawyers of the Law firm “Jurline” were involved at the stage of initiation of procedure for judicial appeal of actions of the State Tax Inspection in order to generate the right case strategy and generally to support the dispute in the court of first instance and in the court of appeal.
При рассмотрении дела Одесским окружным административным судом юристами фирмы была предоставлена суду вся необходимая доказательная база, в том числе получен вывод экономической экспертизы, для доказывания необоснованности позиции фискального органа, в связи с чем иск клиента о признании НУРов незаконным было удовлетворено в полном объеме.
В результате пересмотра решения первой инстанции Одесский апелляционный административный суд вынес определение, которым отказал в удовлетворении апелляционной жалобы ГНИ. Таким образом, спор был разрешен в пользу клиента фирмы.
